Abstract

In Germany, the principle of an employer's culpability applies both in terms of a breach of the employer's statutory social security obligations and with regard to a breach of the enforceability of any failure to comply with these obligations. In Spain, on the other hand, the principle of strict liability of the employer applies at both levels, but only as long as the matter does not relate to the provision of benefits. The contrast between the two legal systems is highlighted in this study, analysing how the issue was dealt with in a recent Judgement of the German Federal Court of Social Security.
