The right to payment and compensation of expenses in Law 10/2021, of July 9, on remote work

Abstract

The compensation of expenses in remote work is one of the major innovations of Royal Decree 28/2020 of 22 September and the Remote Work Act, given the silence of the previous regulations. It is not easy to distinguish between means and expenses, even more so when those expenses refer to the professional and personal needs of the people working. The legislator calls for collective bargaining or a collective agreement to “establish the mechanism for the determination, and compensation or payment of these expenses, being also relevant its concretion in the individual remote work agreement." This study will also analyse the compensation of expenses in collective bargaining and the main pronouncements of our courts.
