The STS of 1 June 2021 and the right to the unionisation of sex workers

Abstract

The Supreme Court ruling discussed above deals with an issue that has been, and continues to be, the subject of heated political and legal debate, probably more intense in these areas than in the social sphere, where the emphasis is perhaps on the issue of trafficking for the purpose of sexual exploitation. The truth is that as a result of this controversy, the courts have at times lost sight of the perspective with which they should approach disputes surrounding voluntary prostitution. This was the case in the lower court ruling that gave rise to the Supreme Court ruling of 1 June 2021, in which the issue of the formation of a sex workers' union (OTRAS) was redirected to its assessment from the perspective of trade-union freedom. The present text deals with the political debates surrounding the issue addressed by the ruling, as well as the unfocused legal debate and the debate centred on the analysis from the latter perspective.
