The consignment of the sum of the ruling in the social cassation appeal: with regard to the Ruling of the Social Chamber of the Supreme Court of 23 June 2021, appeal number 154/2020
Abstract
This paper comments on the ruling of the Social Division of the Supreme Court of 23 June 2021, appeal number 154/2020, which resolves the cassation appeal filed by the legal representation of the company Rhenus Logistics, S.A.U., against the ruling handed down by the Social Division of the National High Court on 20 July 2020, appeal number 128/2020, which declared null and void the measure adopted by the company to suspend 224 employment contracts and temporarily reduce the working hours of 449 workers in the context of the health crisis caused by COVID-19. In the ruling, the Supreme Court focuses on the concurrence of the procedural requirement relating to the consignment of the sum of the ruling in order to prepare the social cassation appeal, provided for in article 230 of Law 36/2011, of 10 October, regulating the social jurisdiction.
