The responsability of enterprises respect to social security benefits because of breachs of the relief contract

Abstract

Partial retirement is a complex figure whose objectives relate to both employment policies and social protection systems. In this sense, the binomial relief contract-partial retirement generates numerous questions respect to the consequences that one of them has on the other one. This essay analyzes the cases in which there is responsability of the enterprise of paying the partial retirement when the enterprise breach its obligations concerning to the replacement worker. The high requirement level does not contribute to increase the interest os companies to this institute.
