The reformulation of causal temporary contracts: progress, inertia, and new dangers
Abstract
The reformulation of temporary contracts brought about by RDL 32/2021 of 28 December has led to the correction of a series of anomalies that were distorting the correct use of causal temporary contracts, leading to valuable advances. In addition, the new permitted temporary contracts are limited to two: the temporary PCP contract and the contract for the replacement of a worker, which eliminates the contract for a specific job and service. However, in addition, the reformulation of the causality of temporary contracts will bring with it a dangerous normality of the eventuality operated by virtue of a controversial causality of the temporary contract, endowed with foreseeability but which is occasional because it is used 3 months every calendar year. Care must be taken to ensure that the extent of the causality involved, together with the continuation of existing inertia, does not render meaningless the control of irregular temporality that the regulation aims to tackle.
