Abstract

The now repealed "maternity allowance" has entailed a series of vicissitudes for the Spanish legislator from the moment of its approval due, among other issues, to its purpose and justification. The ruling of the CJEU, which declared the initiative to be discriminatory towards men, has forced a new configuration of both the objective and subjective scope of the rule, which resulted in the new "supplement to contributory pensions for the reduction of the gender gap" which, although it amends many of the previous critical points, leaves some questions unresolved.
