Abstract

The Supreme Court Judgment of September 28, 2017 analyzes, on the one hand, the competence of the National Institute of Social Security to resolve on the existence of a Permanent Disability. On the other hand, the value of administrative declarations of ineptitude to practice certain professions. In this context, this study analyzes this ruling to determine if it is possible to deprive a taxi driving license as a budget for the Permanent Disability designation. However, in which it is anticipated that the Institute must analyze the administrative declarations; it is non-binding to automatically recognize the existence of a permanent disability.
