Unemployment of part-time workers. About the judgment of the ECJ of 9th November 2017 and the Reform Draft

Abstract

After a preliminary ruling in which doubts were raised whether there was a discriminatory treatment in our Regulation towards part-time workers in the vertical mode (concentrating the working hours on several working days) in respect of the horizontal mode (working less hours during every working day), the ECJ stated that there is gender discrimination. This has caused a reform of the estimate of the period of contribution for unemployment of part-time workers. However, this equalization will not only benefit such workers, but also will be detrimental regarding amount. All these matters will be analysed in this research.
