The incorporation of new technologies in the Spanish Judicial system and the implementation of the so-called new judicial office are generating several dysfunctions. In particular, the one related to the recording of the acts of the trial and the defects in it, especially when after holding the trial it is verified that it has not been recorded in the computer system made available to the court; and what significance it may have in relation to a possible nullity of actions. The Sentence Spanish Supreme Court of January 10, 2023 discussed, unifies doctrine on this topic, broadly addressing the issues arising from it and its significance in the social process.
