Abstract

The Fourth Chamber of the Supreme Court reiterates its doctrine, stating that in the event of de facto separation in which no effective dissolution of the conjugal partnership is proved, be considered a spouse's income (separate in fact) within the economic resources of economic family unit, in order to analyze the economic need as a basic requirement for granting a non-contributory pension.
