The scope of the rule not accumulation of pension article 46 bis.3.c) of Regulation 1408/71 (Commentary of the STJUE of February 12, 2015, case C 114/13)

Abstract

In the STJUE of 12 February 2015 discussed whether the period of time that may be requested dispensation discharge in a compulsory social security scheme, can be considered a "voluntary or optional continued insurance" for the purposes of not to apply ant pension accumulation under national law rule (art. 46 bis, paragraph 3, point c) of Regulation 1408/71. The Court's answer is yes what undoubtedly is favorable from the perspective of pension beneficiaries due in more than one member State of the European Union.
