Abstract

In the procedures for determining and qualifying the permanent disability benefit, controversies may arise that could determine the invalidity of the proceedings. The Supreme Court judgement of 30 April 2007, which is discussed here, refers to the failure to hear the company after the opinion-proposal of the Disability Assessment Team. Hence, it is a question of determining whether there has been any violation of rights or whether the legally established procedure has been completely dispensed with.
