Commentary on the Judgment of the Supreme Court, Fourth Chamber, of 20 January 2022
Abstract
The Fourth Chamber of the Supreme Court states that it is not appropriate to recognise the supplement to the TL benefit derived from an accident at work established in the applicable collective agreement for periods of isolation or contagion as a result of COVID-19. The agreement as interpreted could not foresee the situation caused by the pandemic, therefore interpreting it in a positive sense for the application of the supplement would be an inadmissible extensive interpretation. Moreover, Article 5 of Royal Decree-Law 6/2020 assimilates isolation or contagion by COVID-19 to an accident at work, but only for the purposes of the TL benefit.
