Problems of transience in the delimitation of the age of access to the partial retirement

Abstract

Being aware that, in general, the age of access to early partial retirement is no longer 61 years, but it depends on the periods quoted at the time of the event, the main application problems arise with the regulations in force on December 31, 2012, that they are applied temporarily. This commentary analyzes the age requirement for access to the partial retirement benefit, in those transitional periods (60 or 61 years), from two pronouncements of the spanish Supreme Court (Social Chamber) of September 14, 2016.
