Disputes, indeterminacies and gaps about the status of permanent total disability for the usual ocupation

Abstract

The recognition of a Total Permanent Disability for the usual occupation allows workers to receive a benefit by the Social Security equivalent to 55% of the base salary. This situation forbid the possibility of usual ocupation but not other kind of occupation. Many practical problems remain to solve in brief regulation law. This paper analyzes the new problems to arise in practice.
