The STSJ of the Canary Islands, Social Court of Las Palmas, April 28, 2023, elucidates the application of a clause guaranteeing working conditions for workers of contracting companies, provided for in the sectoral collective agreement applicable to the main company. Despite the recognition of this type of clauses by the jurisprudence of the TS, the ruling under study contains a dissenting opinion that questions the validity and functionality of the clause referred to after RDL 32/2021. This work aims to analyze the indicated ruling, especially highlighting the aspects that we have considered most relevant and showing particular attention to the dissenting vote that supports a change in doctrine in this regard after RDL 32/2021.
