Abstract

One of the issues that causes the most debate in the jurisprudence of the Supreme Court consists, precisely, in determining the regulatory basis for the different benefits of the Social Security system. This is a matter that is not always clear; on the one hand, the rules established by the General Social Security Act will have to be considered but, on the other hand, the circumstances of the specific case are taken into account. Through his rulings, former magistrate Aurelio Desdentado Bonete has always shown his good judgment and interpretative sense, aspiring, with teleological criteria, to respect the very bases that underpin Social Security in Spain.
