Determination of the degree of permanent disability and appeal for the unification of doctrine: Special reference to the visual impairments

Abstract

The judgement of the Supreme Court of Spain of April 5th, 2016 (procedure number 1986/2014), recognizes the degree of partially permanent disability to a lawyer who loses an eye. Despite the difficulties of access to appeal for unification of doctrine to the Supreme Court, the existance of scientific and medical criteria to determine the effect of the dissability in a particular profession, facilitates the appeal. The determination of the requirements of a profession, also enables the Supreme Court to decide about the recognition or revisión of the degree of permanent disability. The reasons for this are that these criteria allow the Supreme Court to adopt a judgement about the determination of the degree of permanent disability, judgement which requires to determine the effects of a particular dissability in the development of the profession.
