The content of the collective agreement: between precedents and change. A contribution to the analysis of the matters subject to collective bargaining made by Professor Borrajo Dacruz

Collective bargaining as a regulatory source of working and employment conditions is the subject of this work published in 2001 by Professor Efren Borrajo Dacruz, focusing in particular on the evolution from the traditional contents of the collective agreement to its new material extension. The two central axes of the evolution of the content of the collective agreement for Prof. Borrajo are, on the one hand, what he calls “law of conservation of legal matter” and, on the other hand, the “reception of new legal issues”. Highlights Prof. Borrajo that collective agreements in their structure or systematics and in their catalog of subjects respond to precedents but at the same time is called to change. In this way, the historical development of any collective agreement has a static character, since it maintains its basic structure; and at the same time changing, because it adapts its content to the vicissitudes that occur in the legal norms of reference and in the aspirations of the parties that sign it.
